Welcome to The Woodlands Conservatory of Music. These Terms of Use explain the ground rules for using our website and for studying with us. By visiting our website, submitting an application, or enrolling as a student, you agree to these Terms. If a student is under 18, a parent or legal guardian agrees on the student's behalf and is responsible for the account.
In these Terms, "the Conservatory," "we," "us," and "our" mean The Woodlands Conservatory of Music and NHVLLC. "You" means the website visitor, the student, and, for minor students, the parent or guardian.
1. Our Services
We offer private and small-group instruction in music and the performing arts, including theory, ear training, repertoire, and technique. Lessons are offered online to students around the world and in person at our private studio in The Woodlands, Texas. In-person study is available by invitation and application only.
2. Admission and Enrollment
Enrollment is not automatic. Prospective students may be asked to complete an application, a Discovery Call, a placement assessment, or an audition. We may accept or decline any application at our discretion. Enrollment becomes final once we confirm your placement in writing and receive your first payment and any registration fee.
You agree to give us accurate information and to keep it current, including contact details, emergency contacts, and any information we need to teach safely and well.
3. Tuition, Fees, and Payment
Tuition reserves a dedicated weekly lesson time held only for you. Current tuition, fees, and payment dates are listed on our [Tuition page] or in your enrollment confirmation.
Tuition is billed [monthly / by term] in advance and charged automatically to the payment method on file.
A non-refundable registration fee of [$___] applies at enrollment and [annually].
Books, sheet music, and materials may be billed separately.
Recitals, masterclasses, exams, and special events may carry separate fees.
Payments more than [7] days past due may result in paused lessons, and your lesson time may be released to another student. A late fee of [$___] may apply.
Tuition is based on a [___]-lesson year. Some months have more lessons than others; this balances out studio closures listed on our [Academic Calendar].
4. Missed Lessons and Makeups
Because your lesson time is reserved for you, tuition is not reduced for lessons a student misses. Makeup options for student absences are described in the [Student Handbook] and are offered as a courtesy, not a guarantee.
If we cancel a lesson, we will offer a substitute teacher, a rescheduled lesson, or an online lesson in its place. There are no makeups for scheduled holidays or for up to [2] weather or emergency closures per year.
5. Withdrawal and Refunds
You may withdraw at any time by giving written notice by email to [email] at least [___] days before your next billing date. Once we receive notice, we will stop future billing. Tuition already paid is not refundable and cannot be credited, except where we cancel lessons we cannot make up or where the law requires otherwise.
We may end enrollment if a student or family repeatedly violates these Terms or the Student Handbook, fails to pay, or behaves in a way that is unsafe or disrespectful to others. If we end enrollment for reasons other than misconduct or nonpayment, we will refund unused prepaid tuition.
6. Online Lessons
Online students are responsible for a reliable internet connection, a working camera and microphone, and a suitable instrument. Lessons lost because of a student's technical problems are treated as student absences. If our connection fails, we will make up the lost time.
For a student under 18, a parent or guardian should be at home and reachable during online lessons.
7. In-Person Lessons at Our Studio
Studio access is limited to enrolled students, their parents or guardians, and invited guests. Visitors are expected to follow studio guidelines, respect our neighbors, and supervise any siblings or guests they bring. Parents or guardians of minor students must drop off and pick up on time.
Participation in music and performing arts involves ordinary physical activity. You agree to tell us about any condition that may affect safe participation and to follow instructor guidance.
8. Recordings, Photos, and Media
We may record lessons for teaching and quality purposes. We will not publish photos, audio, or video of a student for marketing without written consent, which you may withdraw at any time for future use.
Students and families may not record, stream, or share lessons, masterclasses, or other students' performances without our permission.
9. Our Materials and Intellectual Property
Our curriculum, lesson plans, method books, worksheets, recordings, videos, logos, and website content belong to the Conservatory, NHVLLC, or our licensors, and are protected by copyright and trademark law. Enrolled students may use these materials for their own personal study. You may not copy, sell, share, post, or teach from our materials without written permission.
10. Website Use
You agree not to misuse our website, including by attempting to access accounts or systems that aren't yours, uploading harmful code, scraping content, or using the site for any unlawful purpose. Our website may link to outside sites; we are not responsible for their content or practices.
11. Conduct
We want every student to feel safe, respected, and encouraged. Students, parents, and guests are expected to treat teachers, staff, and one another with courtesy, online and in person. Harassment, discrimination, threats, or abusive language will not be tolerated and may result in removal from the program.
12. No Guarantee of Results
Musical progress depends on many things, including consistent practice. We will teach with care and professionalism, but we do not guarantee any particular outcome, such as exam results, competition placement, auditions, or admission to other programs.
13. Limitation of Liability
To the fullest extent allowed by law, the Conservatory and NHVLLC are not liable for indirect, incidental, or consequential damages arising from use of our website or services. Our total liability for any claim is limited to the tuition you paid in the [three] months before the claim arose. Nothing in these Terms limits liability that cannot be limited under Texas law.
14. Indemnification
You agree to hold harmless the Conservatory, NHVLLC, and our instructors from claims arising from your violation of these Terms or from the conduct of you or your guests, except to the extent caused by our own negligence or misconduct.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas. If a concern arises, please contact us first; most issues can be resolved with a conversation. Any legal dispute that can't be resolved informally will be brought in the state or federal courts located in Montgomery County, Texas.
16. Changes to These Terms
We may update these Terms from time to time. We will post the updated version on our website with a new effective date and, for enrolled families, send notice by email. Continuing to use our website or services after an update means you accept the revised Terms.
